Claims from a San Jose State women's volleyball player that her teammate is transgender have made this a controversial season for the Spartans. Now, the university and Mountain West Conference are part of a lawsuit alleging violations of protected rights.

A group of volleyball players and coaches files a lawsuit against the Mountain West, demanding that a San Jose State University player be declared ineligible for the conference tournament.

The plaintiffs include SJSU co-captain Brooke Slusser, assistant coach Melissa Batie-Smoose and two former Spartans players.

The volleyball players in the suit claim the matches forfeited due to the presence of Fleming should not count as losses because the women were simply exercising their First Amendment rights and the newly-enacted TPP should not have passed in the first place.
